G-Unit member, Prodigy of Mobb Deep, will likely be sentenced to 3 1/2 years in prison after he pleaded guilty to criminal possession of a loaded gun Tuesday (Oct. 9). The New York Daily News reports that Prodigy interrupted the trial yesterday to confess to owning the unlicensed .22-caliber pistol found in an armrest of his bullet-proofed Chevy Suburban last October in Chelsea.
As part of a plea deal offered by prosecutors, the rapper will reportedly receive a prison sentence of 3 ½ years. The Queensbridge native was pulled over in Manhattan’s Chelsea neighborhood last October after making an illegal u-turn. When cops searched the bulletproof Chevy Suburban that he and producer The Alchemist were traveling in, they found the illegal .22 caliber pistol stashed in the center console.

Taking this plea bargain was the best thing for Prodigy. He would have been convicted for sure and facing a maximum sentence. When Prodigy made the illegal u-turn, it gave the police probable cause to stop his vehicle. Once probable cause has been established, then an officer can search ANYWHERE within the WINGSPAN of BOTH the driver and the passenger, i.e., the center console, the glove compartment, and under the driver and passenger's seats, all without a warrant. Once the officer(s) discovered the pistol, this gave rise to allowing the officer(s) to search the entire car, anywhere within the driver and passenger's wingspan, the back seat, behind the back seat, the rear of the truck, the trunk, etc, under the automobile exception to the 4th Amendment prohibition against illegal search and seizures.
