The case stems from an incident that occurred in 2000, when city officials requested that concert producers refrain from playing a video containing nudity at the "Up In Smoke" concert at Joe Louis Arena that July.
When the officials discovered that the conversation was actually included on the Up In Smoke DVD, they filed a law suit claiming they didn't know that they were being videotaped.
In the ruling, Judge Murphy noted that the conversation occurred inside a room with an open door. He also noted that at least one of the city employees had entered and exited the room without difficulty.
"Under the circumstances, the plaintiffs could not have a reasonable expectation of privacy" said Murphy.

Dre's attorney moved to dismiss the case in a previous hearing that was held just last October. The decision was surprising to most, since the judge had previously stated to the court during the October hearing that he was inclined to allow the case to go to trial.
On Monday Glenn Oliver, who represented the former Detroit officials, stated that the decision would be appealed. He claims that the cameras were hidden during the conversation.
Dre's attorney, Herschel Fink, noted that this is in fact the third time a judge has dismissed litigation by city employees against Dre over this incident. He originally won the case against them in 2003.
In 2005 Paul Gadola, Flint, Michigan's U.S. District Judge , dismissed their initial lawsuit attempt in which they claimed that what happened was a violation of federal wiretapping laws.
According to reports, Dre's long anticipated Detox album is due to drop in June of next year with a rumored single titled "What You Got" featuring Eminem, Bishop Lamont, and X-zibit to hit airwaves on December 20th.
