Jay Z's 40/40 Club sued by Kanye West, Pharrell, R. Kelly, & Others

Jay Z’s New York City 40/40 Club just got hit with yet another lawsuit.

The popular night spot which has recently been under fire for allegedly underpaying their staff has just been sued by major hit makers such as Michael Jackson, Kanye West, and Pharrell Williams, who are all claiming that the club is playing their music like “Billie Jean,” and “Gold Digger” without paying royalties.

According to TMZ.com, Broadcast Music Inc. filed the lawsuit yesterday in Manhattan District Court on behalf of twelve artists including, Kanye, Pharrell, R. Kelly, and Michael Jackson who’s music is being played without a license.

“A rep for the 40/40 Club says the club hasn’t been served with legal papers, and adds that “under no circumstance” would songs by R. Kelly, whose tune “Thoia Thoing” is mentioned in the suit, be played at the club.

Just cuz some company sued on their behalf, does not mean the artists sued. They might not even know that this is happening. Its called a class-action lawsuit and it happens all the time. Thats how many lawyers get rich. They sue for a group of people, collect a big legal fee and give the people they're suing on behalf of a little somethin. Thats it usually.

Listen kids your publishing company distribute your royalties. Which ever one your have ASCAP or BMI,if you sell your publishing rights then the company owns the rights to your music. Every time your music get play on the radio or any venue that is license by ASCAP or BMI you get a little change not much but it add up depend on how many time your song get play it's the publishing company that is sueing 40/40 not the artist.

In class-action lawsuits, even though the artists aren't the ones that filed the lawsuit, they DO still have to GIVE PERMISSION to use their name in a lawsuit by saying. Take for example the class-action suits for certain types of medicines that have really bad side-effects. The lawyers/law firm contacts as many people they can who have these side effects, and put them all on a list, which is presented in court. They NEED permission to put the names on the list.

If this lawsuit was a class-action suit, BMI's law firm would have to get the PERMISSION of the artists to have their name on a list. Once this is done, the law firm can say that they are suing "on behalf of" those artists on the list.

Regardless of the relationship between Jay-Z and the other musicians, if this is a normal lawsuit, the artists ARE suing, and if this is a class-action suit, BMI is suing WITH the artists' PERMISSION.

However, we don't even know if this article is true. Also, look at what I found on Wikipedia:

"Broadcast Music, Incorporated (BMI) is a performance rights organization. It collects license fees on behalf of its songwriters, composers, and music publishers and distributes them as royalties to those members whose works have been performed."

I went on their official website, and confirmed that this is really what they do.

It is an organization that music artists can join. They don't own the rights to the music, but they do try to inforce them by making sure no one uses the songs without paying royalties to the artists. The artists in question (Kanye, MJ, etc) are part of this organization. BMI sues ANYONE that plays the music, regardless of who it is. It's not that the artists are personally choosing the sue, but it's BMI's obligation to sue anyone that uses the music without paying. I'm guessing that, if they wanted, Kanye, MJ, etc. could probably do something about it.
