G-Unit rapper Tony Yayo (born Marvin Bernard) was in Manhattan Criminal Court this morning (Jan. 10) facing allegations that he struck the 14-year-old son of Czar Entertainment CEO Jimmy "Henchman" Rosemond.
As previously reported by SOHH, the rapper rejected a plea deal last year that would have sent him back to jail for nine months.
Yayo - who, along with G-Unit rapper 50 Cent has a longtime beef with Rosemond over his affiliation with The Game- arrived at approximately 9:45 a.m. wearing a dark grey button down, jeans and white air force ones. He was emotionless.
The New York District Attorney disclosed today that two members of the Hip Hop Police - Detectives Courtney Atkins and Kinely Williams interviewed Yayo's co-defendant Lawell Fletcher at the 13th Precinct the night of his arrest and at Rikers Island on August 8 (where he was being held on an unrelated drug charge). In those interviews Fletcher claimed that it was he who conducted the assault and that Yayo actually restrained him and pulled him off of the kid.
Fletcher was identified in a lineup by Henchmen's son.
Now the Assistant DA has until Jan. 18 to inform the defense whether or not they intend to use the statements and how.
"I am very troubled by The People's disclosure today that they would violate a defendant's (Fletcher) Constitutional rights to council and then bury the information when it helps somebody else," Yayo's lawyer, Scott Leemon, told SOHH. "I'm glad after a year of trying to get information like this that it was finally disclosed in court today. As I said from the beginning Yayo denied ever doing this. This is another witness that said he did not slap this boy."
Leemon has until Feb. 1 to file all motions including the motion to have separate trial.
All parties will meet with the judge again Feb 14.
In related news, the Staten Island home of Yayo's road manager, Barja Walter, was sprayed with bullets and firebombed in the wee hours of the morning on Jan. 8.
A firm trial date has been set for March 31.
