Foxy claims that there is a good chance of her going deaf unless she is able to get to L.A.'s House Clinic for treatment and for repair of a faulty cochlear implant.
Foxy, a.k.a. Inga Marchand 29, revealed her hearing problems during a court appearance in late 2004. Her petition says her condition is worsening in jail and her hearing may be non-existent unless she has the cochlear implant reprogrammed and repaired.
In August of '04, Foxy was placed on probation after pleading guilty to misdemeanor assault of two manicurists at nail salon in Manhattan. She caught a year bid last September after she violated the terms of her probation.
Laura Dilimetin , Foxy's lawyer, asked the judge to amend Foxy's sentence in order to make the medically necessary trip to L.A. However, Assistant District Attorney Cindy Chung objected on the basis that Foxy had offered no proof that the procedure couldn't be done in New York.
She commented that a jail inmate has no right to the doctor of her choice.

Furthermore, Chung opposed the request to amend Foxy's sentence saying, "The mere existence of a debilitating health condition does not merit a sentence reduction, even if it is a terminal illness," said the prosecutor to the judge. "Basically, your honor, this is a desperate and frivolous petition."
Judge Jackson ordered Dilimetin to hand over the Ill Na Na's medical records to the district attorney, the Department of Correction, as well as the Department of Probation so that they can file position papers. She said the records would be sealed.
"I need to have more information on this," said the judge.
Prior to being escorted out of the courtroom, Foxy told the judge she'd had plenty of time to think and has learned a lot in jail, especially ways to suppress her emotions and make better decisions.
"I have too much talent to throw it away," said Foxy,"I know I will make you proud and my family proud."
Judge Jackson responded, "I'm glad you're learning some very hard lessons that needed to be learned."
