According to the suit, they claim the labels should be compensating them half of the net profit from Master ringtones and downloads, more than the lesser rate they are receiving now as per their contract.
The suit claims that an audit of the defendants shows that FBT and Em2M were underpaid by more than $650,000 between the years 2002-05 , due to them not receiving 50% of the net receipts from ringtones and downloads. According to the suit, FBT had been in a recording agreement with Eminem since 1995, then moved to Aftermath in 1998 in conjunction with Em. Through structured agreements and amendments, they managed to maintain their payment of Em’s royalties.
Eminem himself is not included in the lawsuit, but Aftermath, UMG, ARY Inc, and Interscope have been named. Unlike the Sony BMG NYC lawsuit last year, the case FBT and EM2M present is not a class action lawsuit. We will keep you updated as this develops.
